Terms of Use

1.The website

The Swimmetrix website provides general information about Swimmetrix, its team, and swimming-analysis products. The website itself does not provide a user account, accept video uploads, store race analyses, process payments, or provide the full functionality of StrokeLab or an outside service.

2.Permitted use

You may view and use the website for lawful, personal, informational, and legitimate business-evaluation purposes. You may not interfere with the website, bypass security, introduce malicious code, use automated activity that imposes an unreasonable load, misrepresent an affiliation with Swimmetrix, or use the website to violate another person's rights or applicable law.

3.Ownership

The website and its original software, design, text, graphics, logos, videos, reports, and other materials are owned by Swimmetrix or used with permission and are protected by applicable intellectual-property laws. These Terms do not transfer ownership. Except as allowed by law, you may not reproduce, modify, sell, sublicense, or commercially exploit protected website materials without written permission.

Swimmetrix, StrokeLab, OmniCoach, and associated logos and product presentation may be trademarks or branding of Swimmetrix. Other names and marks belong to their respective owners.

4.Products and outside services

Links to StrokeLab, OmniCoach on Poe, sample files, or other websites are provided for convenience. A link does not make an outside service part of the Swimmetrix website or mean Swimmetrix controls that service. Third-party services are governed by their own terms and privacy practices.

OmniCoach currently runs on Poe. Swimmetrix does not control Poe and is not affiliated with Poe or its model providers. You decide whether to send information to that service.

5.Informational content

Website descriptions, examples, sample reports, coaching concepts, and performance information are provided for general information. They may be incomplete, outdated, or unsuitable for a particular swimmer. Nothing on the company website is medical advice, a timing authority, or a substitute for qualified coaching, medical, safety, or professional judgment.

6.Messages and feedback

If you email Swimmetrix, you represent that you have the right to send the content. You keep ownership of your content. You give Swimmetrix permission to use the message as reasonably necessary to respond, provide support, maintain records, and protect the website and its users. Suggestions and product feedback may be used without restriction or compensation, but this does not give Swimmetrix ownership of private race data or other content governed by separate product terms.

7.Availability and changes

Swimmetrix may update, correct, suspend, or discontinue any part of the website at any time. We do not promise uninterrupted access, compatibility with every device, or that every statement will remain current. We may revise these Terms by posting an updated version and changing the effective date. Continued use after an update means you accept the revised Terms.

8.Disclaimer

To the fullest extent allowed by law, the website and its content are provided “as is” and “as available.” Swimmetrix disclaims implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and warranties arising from course of dealing or usage. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

9.Limits on liability

To the fullest extent allowed by law, Swimmetrix and its owners, personnel, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, revenue, profits, goodwill, or opportunities arising from use of the company website. Swimmetrix's total liability for claims relating only to the website will not exceed the greater of the amount you paid directly to use the website during the 12 months before the event giving rise to the claim or US $100.

These limits do not apply where prohibited by law and do not limit liability that cannot legally be limited.

10.General terms

These Terms and the Website Privacy Policy are the entire agreement about the public Swimmetrix website. Product-specific terms remain separate. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; Swimmetrix may transfer them as part of a reorganization, financing, merger, acquisition, or sale of assets. Applicable law and mandatory consumer protections continue to apply.
